When
Can Someone's Life Be Defined As 'Endangered'?
It is useful
to review the legal history these cases at this site to understand the
disturbing frequency with which one woman (Kini Cosma) is singled out
for abuse and a clear political incentive to integrate brutality,
depraved indifference, and conduct extreme and outrageous.
It
begins with Cosma being overpowered with a wrongful conviction via
homophobic invalidated testimonies defaming her further as a 'sexual
predator'.
Consequently,
when the lower Napa County court had not dismissed this essential link
in the chain that led to this woman's wrongful conviction, a
"legallized" abduction of her two minor sons enabled the crisis to
continue for over 20 years.
They
identified her as such in its listing of area sex offenders then
publicly released this information to the community of Auburn,
California. This failure to incorporate her concerns into broader
feminist efforts to address sexual violence has enabled the specific
and particularly brutal patterns of abuse she would soon anticipate
from the rage of neighborhoods placing her at risk in danger zones
where she frequents; areas hard to avoid especially when she is alone.
When Cosma
is in a particularly vulnerable emotional state, homophobia
is motivated to the extent she is forced to encounter a host of
dangers, physical and spatial constraints, and a pervasive sense of
male privilege or entitlement.
Coupled with
inaction, Government officials breached their duty to protect Cosma
from known assailants. They have served, in effect, as accomplices
enabling an entire spectrum of violence exercised by virtue of
dehumanization to punish this biological female for violating gender
norms.
Cosma
contends there has been a pattern of bias-motivated incidents
under the Hate Crimes Statistics Act ranging from verbal harassment to
attempted murder through the intentional infliction of emotional
distress, physical and financial abuse.
Based upon
the undisputed facts, the hatred has manifested itself as an obsessive
will to power. There have been extreme forms of gender- and
sexuality-based discrimination, domination, and violence. Rather, U.S.
officials have responded to her complaints with a depraved indifference
defining this pattern of abuse as a deterioration of Cosma's mental
condition.
Despite
incriminating evidence, the nature of (in)actions have led to the
acting-out against this woman who rejects binary sexual difference from
misogynist and homophobic hatred. Like the punk menaces who grabbed
Brandon Teena, tore off her clothing to ridicule her body, then raped
and shot her to death are like the beginning episodes of forced bodily
exposure in the Napa County jail to the continuity of malicious
prosecutions and state malfeasance to the patterns of deliberately
depriving Cosma of valuable personal property.
When
state and federal courts do not intervene as requested by Cosma, they
ultimately circulate a powerful meaning whereby officials have made it
a public action to reassert male dominance over this woman causing her
to be miserably trapped and resentful for being a misfit in an
intolerant society.

My
case started out in a relatively simple way. I was singled
out by a cop (Debbie Peecook). She arrested me 33 times. I spent the
weekend in jail and was released without a charge sometimes.
Her tool of profession was an illegal restraining order that
they would not let me contest. I never did anything to
her.
Another cop found insignificant items in front of Peecook's house: a
crunched up piece of paper, a merry xmas balloon, a sea shell, a rock,
some stamped post cards, a botts dot (whatever that is)...over a series
of time.
My mother lived a
block away and they have me video'd driving by. They charged
me with stalking (actually I pled from a misdemeanor to a felony
because I had two minor children.) I had totally incompetent
counsel who made me languish in jail over my right to a speedy trial.
He would not provide me a trial because they wanted to dismiss all of
the insignificant items except one. I thought I could leave
the area and reverse my case.) The police stalked me out of
their jurisdiction, blamed me for leaving a business card on someone's
car, blamed me for leaving a fake pearl necklace at a hair studio, and
violated my probation.
They sent me to
prison, enhanced my stalker conviction with a sex offender. As a
result, they took my children out of my custody. Finally, they
dismissed the sex offender charge which has caused the most damages. I
took that issue and ran. They also pilfered my $100k
rightfully inherited trust fund. As a result of
the retaliation because I contested the "sex offender" charge, I suffered a series of physical, psychological, malicious prosecutions, and false arrests . I don't think any woman, let alone a lesbian should have to depend on American men. I left California in an effort to seek asylum because the U.S. Government deliberately suspended my driver's license without an administrative hearing that we are all entitled to.
I have lived in
Klamath Falls, Oregon, for 8 years+ and suffer severe human right
violations and atrocities that have spun out of control here as well.

Plaintiff,
having had excessive government entanglement running afoul of civil and
human rights guaranteed by the U.S. Constitution still without legal
support, has brought separate §1983 and
§2254 actions against the police and other officials
on the grounds that labeling her as a sex offender based upon a policy
enacted after her criminal conviction violated her constitutional
rights.
Infringements
of the Due Process and Ex Post Facto Clauses of the Fourteenth
Amendment privilege against self-incrimination constitutes cruel and
unusual punishment and is in violation of the Eighth
Amendment.
Matter of
fact, the U.S. Government has endorsed cruel and unusual punishment by
continuing to identify plaintiff as a sex offender, allowing her to be
defined as someone who has been convicted, at any time, of any sex
offense or [who] engaged in sexual misconduct during the course of an
offense. They have continued to recommend that she receive
treatment making it their constitutional duty to inculcate cruel and
unusual punishment by portraying plaintiff to the public that
“sexual assault is a heinous crime committed by Offenders
with deviant behavior patterns that cannot be controlled by
incarceration alone.”
Still no
remedies are available for these violations or the disparate treatment
set forth under Title VII while retaliating against plaintiff by
conspiring against her rights under 18 USC §241.
Who I Am-
Detained Indefinitely Through Petty Legal Limbo
There are deeper problems in our country than we
even know. Laws have a way of
legitimating prejudice, which unleashes brutality even in
normally mild, respectable citizens. This encourages meanness and
cruelty, even to the point of making it acceptable to kill
"undesirables" among us.In

I was convicted as a felony stalker and sex

At the cost of doing business, this author has

neglect have included the icy sophistry prolonging mental anguish,
inhuman and degrading treatment profoundly separating her from the
human family.
The serial abusers have been law enforcement
officers from the cities of Napa and Susanville in California to
Klamath Falls, Oregon who

I was profiled as a lesbian and
arbitrarily arrested excessively since 1989-1995 (approx 40
times-landing in prison on July 4th, arrested on Martin Luther King
Day, arrested 1st business day of 2011, sent to a mental institution on
March 1, 2011: my birthday). When I was wrongfully convicted
of "stalking", the status was enhanced to include a "sex offense" after
I was sent to prison. Branded a “sex
offender,” I lost custody of my two sons. The
officer has since been charged with excessive force by another attorney.
All
legal activities others are entitled to have become illegal for me. All
my business ventures were deliberately destroyed and frustrated and
they have left me to languish resulting in loss of liberty,
civil rights, productive lifestyles, financial and personal ruin,
mental anguish, social condemnation and personal and family
embarrassment.
I
have appealed to the Federal courts since 1995 and ALL of my cases were
dismissed without review. All of the difficult and dedicated work I've
done was ignored while federal judges demanded that I complete more
work. Even though Federal judges know I am not the
“Betty Crocker” type girl, they have become
obsessed with “curative rape” by forcing their
disregard on me making me an object of ridicule and scorn in order that
I submit to and service their American Men.
As
a result of my legal battles against the U.S. Government, I have become
an extremely unfavorable person subjected to and having to suffer
severe retaliation. I noticed my $100k rightfully inherited
trust fund was wrongfully pilfered/seized after I asked the 9th Circuit
Court of Appeals to suspend the powers of the trustee. I also noticed
that at least two attempts to entrap me in illegal ponzi schemes
occurred while I was suffering brutality at the hands of the Lassen
County community in California. I have also lost other real property
and vehicles wrongfully seized and confiscated by the states of
California and Oregon authorities.
The
state and federal courts, in both California and Oregon, deliberately
set me up to fail refusing to grant me asylum or protection from
persecution and using me as a human battering instrument for others in
the community to abuse, physically and emotionally. Those in
the community banter me because they just want me to shut up and go
away and endure the sexual harassment. Because of the selfish reasons
of those who conspired for my false imprisonment, other malicious
prosecutions and judicial injustice has taken place. Impropriety,
prosecution for the sake of prosecution, lack of funds for
legal aid to prove my innocence and/or other errors of one kind or
another, has occurred.
Just recently throughout August
and September 2011, I diligently sought housing. Finally relying on the
verbal agreement made by manager's Christopher John and Ericka
Little of Wiseman's Mobile Home Park at 6800 South 6th Street
in Klamath Falls, Oregon. Previously managers Christopher John and
Ericka Little declared to me that they made a visual inspection of my
residential travel trailer at another location and approved thereof,
preserving the certain space for me to move into on October 3, 2011.
Relying on said verbal agreement, I halted any other effort to seek
housing else before the winter's debilitating freeze that caused my
health breakdown (including hearing loss) the previous season.
I paid rent due, and
moved my residential trailer in. When I relocated my residential travel
trailer to Wiseman's Mobile Home Park at 6800 South 6th Street in
Klamath Falls, Oregon, on October 3, 2011, said management used
bantering and forcible hostilities1 against me to unlawfully evict me
without proper legal notice making the excuse that my trailer was not
in compliance to their standards. Said management had a limited
contractors license that definitely did not include having the
authority to inspect the electrical components in my trailer.
Coincidently,
the Klamath County Sheriff's department was right there to assist in
these civil matters by forcibly running me out of the mobile home park
regardless that rent was paid. As a result, I have been
housed in an illegal concentration camp type setting with
barbed wire all around while staff of the Klamath County Sheriff's
Department are, coincidentally, tenants in the immediate vicinity
asking me to secure their property.

actions also have interfered with all of my legitimate home office
based businesses. (disconnecting electrical utilities, forcing me to
spend money to seek resources the government will block, excessive late
fines and fees) The pattern of abuse goes on and on with constant
patterns for propensities of humiliation always setting me up in an
illegal manner to justify their means for, yet, another malicious
prosecution. Having to urinate in buckets and defecate on newspapers
prove their successful effort for making me live like an animal
unworthy of attention or exposure to their pattern of consistent
horrific human right violations.
Regardless
of the well-founded fears of persecution on the grounds of my
being a member in a particular social group demonstrating my political
opinions... I remain ignored and undefined as an disenfranchised,
elderly, sex offending-stalker, Caucasian, Jewish, lesbian, woman
vulnerable to U.S. Government abuse and oppression suffering their
prevailing patterns of consistent years and years of physical and
emotional abuse in both California and in Oregon.
While
others qualify as refugees to be granted asylum or protection
somewhere in the United States, the harm feared is being inflicted by
the this government...and by persons and organizations that the
government is unable or unwilling to control. I have contacted 1000's
of agencies connected only in the legal industries relying on those
agencies for answers. While they were asleep, I was sent to mental
institution for several months on bogus charges, again, my civil rights
were violated. Anonymous people are coming out of the
woodwork who I do not know, nor should have any information regarding
my civil and human right violations in the communities I am transient
in. So, why are they hostile and derogatory using such efforts to
intimidate and harass me?

As you know local, state, and
federal officials (the U.S. Government 'officials') has targeted this
author (me) by using punks to menace and drive me from city to city,
state to state. They have also used individuals to perjure and lie in
an effort to cause extreme mental and emotional anguish in an effort to

on, I groveled revealing my marketing plan to him. He knew I was going
attempt to host a screening at a local taco shop on March 23,
2012.
Regardless,
the individual "leaked" my employment plan to Christoper J.
Little, from Wisemans Mobile Home Park. This influenced him to visit
the taco shop during my hosting event. My vehicle is an obvious one,
parked in front of the taco shop with a few others. When Little saw my
vehicle out front, he decided to appear after the injuries and damages
he has helped to esculate. He knew his mere presence to scoff
in my face would intimidate, degrade, and humiliate me in order to run
me away from my legal activities. 25 years of the same pattern of
abuse.

45 year old Kini Cosma was walking down a street in Napa, California on Friday evening when the above female police officer, Debbie Peecook, decided to arrest Cosma because she looked like a lesbian. Matter of fact, Cosma was arrested over 25 times by the same above female officer just for walking down the street. Cosma was not allowed to travel any further than a 2 mile radius.
The officer sent Cosma to prison to get her ass beat, then, sent her to Susanville, California to get her ass beat there. Not satisfied that Cosma was not beat to death, the officer intended to indirectly cause Cosma's death by a third party. After pilfering her $100k rightfully inherited trust fund and "legally" abducting her two minor sons, California officials ran her out of the State of California to Klamath Falls, Oregon where the female officer had others beat her ass at the High Lake Apartments. The officer then had other's beat Cosma's ass at the Harlen Drive property.
Knowing that Cosma was always self-employed, Oregon law enforcement were told to confiscate all of Cosma's business vehicles so she would have to depend on and service American men. One KIamath County Sheriff confiscated her residential van and threw Cosma's underware all over the Fairgrounds property...These very real stories can go on and on and on...To this day, Cosma is not permitted to travel any further than a 2 mile radius.
Cosma's horrific human and civil right violations are a part of a string of anti-LGBT violence in Napa, California and bias-motivated crime around the country. It could have been you, your friend, your son or daughter.
Kini Cosma didn't do anything wrong. She didn't break any laws, start any fights, or harm anyone. She was simply open about who she was. And for that, she was ordered to be beaten up by law enforcement and other U.S. officials.
Every LGBT person and ally who hears about this deliberate indifference and the covering up of exculpatory evidence would even have a deeper reaction: That could have been someone I love.
Imagine growing up knowing that your life could be over in an instant. That walking down the sidewalk on an ordinary Friday night, you or your friend could be alive one minute and gone the next. That's the reality. And if it can happen in Napa, California, it can happen anytime, anywhere.
Discrimination remains embedded in this nation's laws. And as long as it trickles down into our schools and our communities, your constituents will continue to suffer from these crimes and the terror they instill. We all have a duty to stand up, ordinary citizens and elected officials alike. Passive support isn't enough.
The next Kini Cosma is out there right now, running out of time. We cannot, must not stop until our nation's laws – at every level – treat all Americans equally, in every aspect of life, with the dignity we all deserve.
